Terms & Conditions

The following Terms & Conditions apply to all services offered by Jobers. By using our services you agree to the following conditions near their integrity and without modification:

1. Applicability

These Terms and Conditions rule the contractual relationship between the client and Jobers. Any person or company who places an advert on Jobers applications and online platform is a client. The Terms and Conditions apply to all agreements between the client and Jobers about services and products offered by Jobers.

2. Right of access

Jobers grants the customer the right to access, using a user ID with single verification email and a password, to Jobers applications which are subject of the agreement between Jobers and the client. Jobers considers that the customer is the one that uses the user ID and password, regardless of whether that person actually has the right of access.

3. Benefits and benefits change

All Jobers benefits are free for both job seekers and employers. The user selects the services to be provided by Jobers among the range of services available at the time of subscription. The services are described on Jobers' website. Jobers offers employers, recruitment agencies and job seekers a service of adverts publishing (job vacancies ads published by employers/recruiters and services offering ads published by people looking for a job).
Jobers reserves the right to change the range of services at any time, without notice or reasons, or to partially or completely stop its service offering. Such modification or termination in the services supply does not entitle the user to assert any claims vis-à-vis Jobers.

4. Rights and obligations of the customer

The customer agrees to use Jobers' internet platform in accordance with the law and contract. In particular, the customer agrees to respect the Terms of insertion which apply to Jobers. These are an essential part of these Terms and Conditions. Customers are responsible for the content of their online advert and Jobers acts as publisher of these liabilities and their publication. Advert content includes any information (text, photo, audio, video) that you provide Jobers or other members during the registration, transaction and publication of adverts process. This includes both the text and the images. You agree that Jobers can view and control the adverts before they are published. Jobers may refuse, edit and reorganize any content that is provided by the members.
If the customer fails to meet its obligations, Jobers has the right to disable or delete their account and refuse any current or future use of its services.
Jobers reserves the right to change or terminate, temporarily or permanently, all or part of its services at any time and without notice.

5. Intellectual property rights

All copyrights and trademarks, as well as expertise on Jobers online platform and applications belong exclusively to Jobers. Insofar as the contractual use applications Jobers by the customer assumes the rights to use copyrights, trademarks and / or know- how owned Jobers, they are granted by the customer Jobers non-exclusive, non- transferable and to the extent necessary for the duration of the relevant agreement. If it is agreed with the customer Jobers will use a third party application, this paragraph also applies, mutatis mutandis, to this application. The rights granted to the client to use applications and platforms online Jobers and third-party applications (see figure 12) are personal and not transferable. All documents relating to the subject, photos and templates created by Jobers order of the customer are the property of the client. By posting content on applications and platforms online Jobers, the client grants Jobers a right of use and disposal of these non-exclusive content, not limited in time and without compensation.

6. Content of ads published on Jobers

You certify that the information and content you post on Jobers are:

  • Not allowed under the conditions for the advertiser,
  • True, up-to-date,
  • Complies with reality,
  • In accordance with the law in force in Switzerland,
  • Not defamatory,
  • Not obscene,
  • In accordance with the " Terms of Use " and " Privacy Protection " 

7. Data protection

The customer authorizes Jobers to integrate data by agreement, as e.g. data to be published online, including items related there, such as text, graphics, images, plans, etc, the platform online Jobers and other online services offline own or belonging to third parties. There are, however, no right to publication in the media. Jobers has, at any time, the right to terminate, modify or entirely cease publication in the media release for any reason whatsoever and without financial consequences. But insofar as it is a free advertising service for the customer, there is, under the present CG, a right to the publication on the online platform Jobers.ch or site Internet equivalent. Similarly, Jobers reserves the right to use published data for other purposes, either for itself or for others, for example, to perform statistical, or published in any other way, and to this end to save and to treat. The customer expressly consents to the direct and / or indirect data necessary for the use of third party applications (see figure 12) from the application of Jobers to the application or third-party applications, as well as safeguarding such data in their (s) bank (s) of data. The Client acknowledges and agrees that the data relating to its contractual relationship with Jobers can be transmitted by Jobers to other companies in the same group for processing. The customer agrees to expressly accept the use of its data by third parties. Jobers agrees to comply with the rules of data protection in force. Jobers cannot completely guarantee confidentiality, unfalsifiable and authenticity of customer data published online. The client acknowledges in particular the fact that personal data can also be viewed in states that do not have provisions for data protection comparable to those in force in Switzerland.

8. Cookies

Jobers uses Google Analytics in its website, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses cookies, which are text files placed on the customer's computer, to help the website analyze site usage by users. The information generated by the cookie about the use of the website by the client (including the client IP address (will be transmitted to and stored by Google on servers in the United States. Google will use this information to evaluate the use of the website, compiling reports on website activity to his publisher, and providing other services relating to website activity and the Internet use. Similarly, Google may also transfer this information to third parties where required by law or where such third parties process the information on Google's behalf. Google will not associate if the client IP address with any other data held by Google. The customer can disable the use of cookies by selecting the appropriate settings on their browser. However, Jobers informs the client that this may prevent from using certain features on this website. By using this website, the customer consents to the processing of data performed by Google in the way and for the purposes described above.

9. Risks

The customer bears all risks that may arise as a result of manipulations on its computer system, malfunction of the computer system and / or misuse of access rights.

10. Responsibility

10.1 Responsibility of Jobers

Jobers provides its services with diligence and professionalism. Jobers cannot guarantee uninterrupted availability or no mistake of its services. Jobers is not liable for any outages, or for any technical failures and their consequences. Listings of job offers adverts and candidates profiles displayed on Jobers are created by users and Jobers does not guarantee the accuracy or completeness of the information. Jobers strives to prevent unauthorized use by third parties of published data on its platform. Any liability Jobers if unauthorized use by third parties is nevertheless expressly excluded. Jobers also does not give any warranty as to the success of a job vacancy advert or the publication of a profile. In all cases, the responsibility Jobers limited to fraudulent intent or gross negligence. Liability for incidental or consequential damages is excluded.

10.2 Responsibility of users

The customer is responsible for the legality, accuracy and completeness of the content made available or submitted for publication on Jobers' platform and partner platforms society. Jobers is responsible for the diligent and confidential custody of its user (his usernames and passwords, in particular) and all activities that occur through the access data. The user responds to Jobers, irrespective of fault, for all damages and costs arising from the violation of these Terms and Conditions or any other part of the contract. It is committed to fully release Jobers all claims raised by third parties against Jobers following the use by the user platforms Jobers and its partner platforms. Damage repair also includes the reasonable cost of prosecution. Jobers inform the user of all claims raised by third immediately.

11. Using third-party applications

Whenever the customer uses third-party applications integrated into applications and / or platforms online Jobers, he accepts the conditions of use for these applications.

12. Prohibition of compensation

The customer has no right to pass the contractual relationship with Jobers to a successor without written agreement from Jobers. Similarly, the requirements from the contractual relationship with Jobers cannot be transmitted to third parties without written approval of Jobers.

13. Assignment of rights and obligations to third parties

Jobers reserves the right to transfer rights and obligations under this Agreement to third parties or to made it exercised by third parties.

14. Change in contractual conditions

Jobers reserves the right to amend these T&C at any time. The current version of these T&C, published on Jobers' website applies between the user and Jobers. Jobers notify users of changes to these T&C timely on its website or other adequately.

15. Governing law and juridiction

Presented the T&C and other integral parts of the contract are exclusively governed by Swiss law. The place of performance and exclusive jurisdiction is the headquarters of Jobers. Jobers is also authorized to pursue the client in front of the court of the headquarters / domicile .
